Bankston, Larry S. (Attorney)

(Note:  Mr. Bankston is a

===> When, at the November 5, 2014 LALB meeting, audience member Judy 

         Fasola questioned why the LALB filed bond claims for David Swift and Brant

Thompson, son of State Sen. Francis Thompson, yet steadfastly refused to do so

for her, Fasola manages to catch board members in one contradiction after another

and readily demonstrating that they WILL treat auction victims differently.

Bankston in particular demonstrates his usual abrasive behavior in relaying to

LAPA Vice President Robert Burns that he won't be permitted to speak and, as

result, permitted Vice Chairman James Sims to repeatedly make a fool of himself

regarding the timing of restrictions being removed from Ken Buhler's license. 

Bankston also got very testy with Ms. Fasola relaying "the restrictions were not part

of the hearing" when, in reality, they dominated the hearing! 

 

 

===> Makes fool of himself regarding his lack of knowledge of public records

        requests.


===> Readily demonstrated in posing questions during deposition that he is NOT

        even familiar with what THE PLEADINGS THEMSELVES relay!!!

 

===> Suffers humiliating courtroom defeat on ill-advised Writ of Attachment. 

 

 

===> Remains silent while Board Member Darlene Jacobs-Levy, despite her own

        43 years of legal practice (in NEW ORLEANS), relays that "Mr. Bankston

        has never been censured by any court that I'm aware of."

for her, Fasola manages to catch board members in one contradiction after another

and readily demonstrating that they WILL treat auction victims differently.

Dow in particular is exposed for having Ms. Fasola jump through many hoops in

relaying to Ms. Fasola that the LALB would file a bond claim for her, only to

reverse course six (6) weeks later and relay that they would not (a fact she didn't

bother with communicating to LALB Chairman Tessa Steinkamp or Vice Chairman

James Sims. 

 

===> "Are you carrying a weapon?" inquiry made four (4) times by Ms. Dow to

 LAPA President Rev. Freddie Phillips.

 

===> Dow repeatedly threatens to sue Phillips over his questioning of a payment to her

for attending an auctioneer's conference as a potential misappropriation of funds.

Gay, Delmar "Buster" (Past Chairman)   

 

===> Relays that LAPA Pres. Rev. Freddie Phillips may be an "embarrassment to

the State" if he is permitted to attend a national auctioneer convention as an

LALB representative.

 

===> "Why is all this necessary?" Gay demands of Phillips regarding his quest

for LALB travel records.

regarding "character bashing" which Ms. Stuard contended Mr. Gay

Henderson merely sits stoically during the entire presentation! 

 

===> Repeatedly speaks in barely audible voice at January 15, 2014 LALB

         meeting in a concerted effort to prevent audience members from hearing

         what he is saying.

 

===> Lawsuit filed against Mr. Henderson's company, J. A. H. Enterprises

         d/b/a Henderson Auctions, by the Louisiana Department of Revenue on

         November 15, 2007 for alleged nonpayment of sales taxes.

Hunter, Lindsey (Adm. Law Judge - AG Caldwell)  

 

===> Provides utterly absurd guidance to LALB to seek relief in 19th JDC

         for LAPA Vice President Robert Burns walking out of a hearing on

         March 5, 2013 after Ms. Hunter granted an "oral instanter subpoena"

to Burns when the LALB had failed to issue a formal, written subpoena.

As a result of Louisiana Attorney General James D. "Buddy" Caldwell's

flawed guidance, as exhibited through Ms. Hunter, the LALB flushed

$2,100 right down the toilet in legal fees pursuing an ill-advised Writ of

Attachment against Burns which was denied by 19th JDC Judge Todd

Hernandez on August 28, 2013 after oral arguments were posed on

the matter in his courtroom on July 22, 2013.

Jacobs-Levy, Darlene  

 

===> When, at the November 5, 2014 LALB meeting, audience member Judy 

         Fasola questioned why the LALB filed bond claims for David Swift and Brant

Thompson, son of State Sen. Francis Thompson, yet steadfastly refused to do so

for her, Fasola manages to catch board members in one contradiction after

another and readily demonstrating that they WILL treat auction victims

differently.  Jacobs-Levy in particular contradicts herself from a previous meeting

by relaying Ms. Fasola must obtain a "sum certain civil judgment" before the LALB

can assist her, in sharp contrast to her having relayed to Brant Thompson 

that the "LALB can find Mr. Miller (the auctioneer) guilty and file a bond claim,

and it will be up to the bonding company to determine the amount of your payment."

 

===> While seemingly flattered at her alleged invitation to call auctions by

          auctioneer Dave Gilmore, she nevertheless says Gilmore Auction is

        "not well-liked." 
           

===> Seemingly out-of-the-blue, states that Gilmore Auction and J. P. King

         Auction (Gadsden, AL) have engaged in deceptive practices regarding their

        advertising of absolute (sells regardless of price) auctions.

 

===> Provides wildly inaccurate accolade of prospective LALB attorney hire

         Larry S. Bankston.

Linn, Jenna  

 

===> Rudely interrupts LAPA Vice President Robert Burns during his opening

          comments of the March 10, 2015 minutes when Burns references his working

          with FBI agents during his 6-year tenure as a fraud investigator for the FDIC.

          For the benefit of the many new out-of-state auctioneers who now receive

LAPA email alerts of meetings' contents, Burns prepared a special post-meeting

video to explain why Linn had such a knee-jerk reaction to the phrase "FBI

investigations."

McMillin, Charles "Hal"  

 

===> Laughs in engaging in a "private conversation" with fellow board member

          Jeff Henderson during LAPA Vice President Robert Burns public comments.

          When Burns calls him on the carpet about it, he blows a gasket at Burns and

          resigns from the LALB soon thereafter. 
  

 

===> Admits he is totally unwilling to report an "auctioneer" operating with no license

          because "he's a writer for the local paper and would chastise me in his column and

          because this would all come back to me!"

Sims, James (Vice Chairman)   

 

===> When, at the November 5, 2014 LALB meeting, audience member Judy 

         Fasola questioned why the LALB filed bond claims for David Swift and Brant

Thompson, son of State Sen. Francis Thompson, yet steadfastly refused to do so

for her, Fasola manages to catch board members in one contradiction after

another and readily demonstrating that they WILL treat auction victims differently.

Sims in particular continued to make a fool of himself in relaying INCORRECTLY

that restrictions on Ken Buhler's license (Fasola's complaint was against Buhler)

were lifted BEFORE her auction when, in reality, they were issued eight (8)

months AFTER her auction.

===> Becomes quite testy with LAPA President Rev. Freddie Phillips when Phillips

merely seeks clarification of a statement Sims made regarding auto auctions.

===> Lambasts Gov. Jindal for slashing LALB per diem payments.  Sims:  "Maybe we

need to go see the Governor and see if he wants to give up his own salary."

 

===> Accuses LAPA President Phillips of "after-the-fact witch hunts" regarding his

inquiry of an LALB payment for attorney Anna Dow attending an auctioneer

conference without LALB approval after Phillips had been formally denied a

request to attend the conference as an LALB representative. 

 

===> Flaunts disdain for Gov. Jindal by inquiring, "Is our fine Governor still trying to

raid the funds of this Board?"

 

===> Provides testimony before LA House Committee on Criminal Justice AGAINST

HB-1439, a bill to strengthen LA's laws on shill bidding.

Steinkamp, Tessa (Chairman)   

 

===> When, at the November 5, 2014 LALB meeting, audience member Judy 

         Fasola questioned why the LALB filed bond claims for David Swift and Brant

Thompson, son of State Sen. Francis Thompson, yet steadfastly refused to do so

for her, Fasola manages to catch board members in one contradiction after another

and readily demonstrating that they WILL treat auction victims differently.

Steinkamp in particular blew several gaskets with Ms. Fasola even though, in every

instance, Fasola was correct and Steinkamp demonstrated in the meeting that either

1) she was wrong, or 2) communication was so poor between Steinkamp, attorney

Anna Dow, and Executive Director Sandy Edmonds that Steinkamp demonstrated

ignorance of previous episodes Ms. Fasola had been subjected to regarding

filing a bond claim.

 

 

===> In her zeal to keep LAPA President Rev. Freddie Phillips from speaking on

         pertinent auctioneer issues, Chairman Steinkamp makes a COMPLETE

         FOOL of herself.

 

 

===> Becomes quite testy with LAPA President Rev. Freddie Phillips when Phillips

moves in order to better hear Board Members while videotaping meeting. 

 

===> Threatens "disciplinary action against your [Phillips'] license" regarding

Phillips' call for a new Vice Chairman election in light of all the adverse

developments (including bankruptcy) regarding New Orleans Auction

Galleries, Ms. Steinkamp's employer and a firm for which she served as

Vice President, Secretary, Director, and Treasurer until 11 days prior to

bankruptcy (she was rehired soon after bankruptcy).

 

===> Bluntly tells Phillips that she voted not to send him to a national auctioneer

conference as an LALB representative because, "I wouldn't want you to

represent this Board." 

 

===> Is called on the carpet by audience member (and then-auctioneer) Nell Stuard

regarding "character bashing" which Ms. Stuard contended Ms. Steinkamp

engaged in previously in the same meeting regarding LAPA President Rev.

Freddie Phillips.

 

===> Demands LAPA Vice President Robert Burns resign from the LALB after

Burns began delving into improprieties at the LALB office as well as the LALB's

unwillingness to enforce shill bidding laws and Burns voicing his discontent over

same.

Vallan, James Michael (Adm. Law Judge - AG Caldwell)  

 

===> Provides utterly absurd guidance to LALB stating that they can

         convene an illegal Executive Session to discuss the character of

         LAPA Vice President Robert Burns on September 17, 2012 over

the explicitly-stated intent, voiced through his attorney, Robert

Loren Kleinpeter, to invoke his RIGHT to have such discussions

take place in an open session.  As a result, Burns filed an open

meetings lawsuit violation against the LALB, resulting in the

LALB literally spending tens of thousands of dollars defending.
